Terms of Service

1. Acceptance of Terms

By accessing or using the Tingle Loop application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms constitute a legally binding agreement between you and Tingle Loop regarding your use of the App and all ASMR audio content, trigger libraries, and looping features made available through it.

2. Description of Service

Tingle Loop is a relaxation and sensory experience application designed to help users discover, customize, and loop ASMR (Autonomous Sensory Meridian Response) audio triggers. The App provides access to curated trigger libraries, personalized soundscapes, loop sequencing tools, and community-shared audio content intended to support relaxation, focus, sleep, and general well-being.

3. User Accounts

To access certain features of the App, you may be required to create an account. By doing so, you agree that:

You will provide accurate and complete information when creating your account
You are responsible for maintaining the confidentiality of your account credentials
You are responsible for all activities that occur under your account, including any audio content you save, share, or upload
You will notify us immediately of any unauthorized use of your account
You must be at least 13 years of age to create an account; users under 18 should have parental or guardian consent

4. Acceptable Use

Tingle Loop is intended to be a calm, respectful, and safe environment. You agree not to:

Use the App for any unlawful purpose or in violation of any applicable regulations
Upload, share, or distribute audio content that is harmful, harassing, obscene, or deceptive
Attempt to gain unauthorized access to any portion of the App or its underlying infrastructure
Interfere with or disrupt the App’s functionality, servers, or other users’ experience
Use automated tools, bots, or scripts to scrape, download, or bulk-access ASMR content from the App
Reverse engineer, decompile, modify, or create derivative works of the App or its audio content
Misrepresent the nature or origin of any audio content you submit to the App

5. Audio Content & ASMR Triggers

Tingle Loop provides access to a library of ASMR trigger audio content, including but not limited to tapping, whispering, scratching, crinkling, and ambient soundscapes. Please be aware of the following:

ASMR responses vary significantly between individuals. Not all triggers will produce the same effect for every user.
Loop duration, trigger sequencing, and volume levels are fully customizable, but you are responsible for listening at safe volume levels to protect your hearing.
Tingle Loop does not guarantee that any particular trigger or soundscape will produce a specific sensory or emotional response.
Some users report that ASMR content may cause drowsiness. Do not use the App while operating a vehicle or performing any activity that requires full attention.

6. Health & Wellness Disclaimers

Tingle Loop is designed for relaxation and personal enjoyment. It is not a medical or therapeutic device. Specifically:

The App is not intended to diagnose, treat, cure, or prevent any medical or psychological condition
ASMR audio content is not a substitute for professional mental health support, therapy, or medical advice
If you experience discomfort, anxiety, or adverse reactions while using the App, discontinue use and consult a qualified healthcare provider
Users with sensitivity to sound, hearing conditions, or certain neurological conditions should consult a healthcare professional before use
You use the App’s audio features entirely at your own risk

7. Intellectual Property

All content within Tingle Loop, including audio recordings, trigger libraries, interface design, and branding, is protected by applicable intellectual property laws. The following terms govern ownership and licensing:

Tingle Loop and its original content are owned by us and protected under copyright, trademark, and other applicable laws
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for personal, non-commercial purposes
You retain ownership of any original audio content you record and upload to the App
By submitting content to the App, you grant us a worldwide, royalty-free license to host, display, and distribute that content as part of the App’s functionality
You may not reproduce, redistribute, or commercially exploit any App content without our express written permission

8. Third-Party Video Content (YouTube)

Tingle Loop allows users to discover and loop ASMR videos via an embedded YouTube player within the App. Please be aware of the following important limitations:

Tingle Loop does not own, host, upload, or control any videos played through the embedded YouTube player. All video content is owned by the respective YouTube creators and/or rights holders.
Videos are streamed directly from YouTube’s platform via the YouTube IFrame API, and their availability is subject to YouTube’s terms, the uploader’s settings, and applicable copyright law.
We are not responsible for the content, accuracy, availability, or removal of any third-party videos. If a video becomes unavailable on YouTube, it will no longer be accessible through the App.
Your use of YouTube content within the App is also governed by YouTube’s Terms of Service (youtube.com/t/terms) and Google’s Privacy Policy (policies.google.com/privacy).
Tingle Loop does not claim any ownership or affiliation with YouTube, Google, or any video content creators whose videos may appear in the App.
If you believe a video accessible through the App infringes your copyright, please report it directly to YouTube via their copyright complaint process. We will cooperate with takedown requests as required by applicable law.

9. Community-Shared Content

Tingle Loop may allow users to share custom trigger loops and soundscapes with the broader community. By participating in community sharing:

You confirm that you have all necessary rights to share any audio content you upload
You understand that shared content will be accessible to other users of the App
We reserve the right to remove any community content that violates these Terms or our content guidelines, without prior notice
We do not endorse or verify the accuracy, quality, or safety of community-shared content

10. Privacy

Your privacy matters to us. Our Privacy Policy describes how we collect, use, store, and protect information related to your use of the App, including your listening preferences, session data, and any content you upload. By using the App, you consent to the data practices described in our Privacy Policy, available within the App and on our website.

11. Modifications to Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will notify you through the App or via the email address associated with your account. Your continued use of the App following notification of changes constitutes your acceptance of the revised Terms.

12. Termination

We may suspend or terminate your access to the App at our discretion, with or without notice, if we determine that you have violated these Terms or engaged in conduct that is harmful to other users, the App, or us. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including intellectual property rights, disclaimers, and limitations of liability) will continue to apply.

13. Disclaimers

To the fullest extent permitted by applicable law:

The App is provided “as is” and “as available,” without warranties of any kind, express or implied
We do not warrant that the App will be uninterrupted, error-free, or free of harmful components
We make no representations regarding the accuracy, completeness, or reliability of any audio content available through the App
We are not responsible for any adverse reactions, sensory experiences, or health outcomes arising from your use of ASMR content

14. Limitation of Liability

To the maximum extent permitted by law, Tingle Loop and its affiliates, officers, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the App or its content. Our total liability for any claims related to the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.

15. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising out of or in connection with these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts in the jurisdiction where Tingle Loop is incorporated.
